Conditions of withdrawal

Right of Withdrawal of the Customer – Withdrawal of RONCHI & RONCHI di Ronchi D. and Ronchi M. Snc

Pursuant to art. 64 and following of the Consumer Code, the Consumer has the right to withdraw from the purchase without any penalty and without specifying the reason. To this end, he must send a communication to the Customer Assistance Service of RONCHI & RONCHI di Ronchi D. and Ronchi M. Snc by e-mail or – alternatively – by fax or registered letter with acknowledgment of receipt, to be sent within 14 working days. from receipt of the selected Products and / or Services. The return of the Products subject to withdrawal must be made, at the expense of the Consumer, by courier of their choice, to the following address: RONCHI & RONCHI di Ronchi D. e Ronchi M. Warranty – Returns

Intellectual Property Rights

Supply conditions

I pagamenti in esecuzione dei Contratti di Vendita potranno essere effettuati mediante contrassegno, con bonifico anticipato o con il sistema PayPal.
Al momento della formulazione dell’Ordine, il Cliente è tenuto a indicare la modalità di pagamento prescelta. Qualora il Cliente decida di procedere all’acquisto dei Prodotti e/o Servizi con pagamento del prezzo tramite PayPal, l’importo complessivo dovuto per ciascun Contratto di Vendita verrà addebitato contestualmente alla conclusione del processo d’ordine.
RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc si riserva la facoltà di chiedere al Cliente, in qualsiasi momento, l’invio di informazioni integrative e/o documenti comprovanti la veridicità dell’ordine o del pagamento effettuato dopo il Contratto di Vendita.
Qualora il Cliente non ottemperi alle richieste, RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc si riserva la facoltà di non accettare l’Ordine, ovvero di recedere dal Contratto di Vendita perfezionato, dandone tempestiva comunicazione al Cliente all’indirizzo di posta elettronica indicato nell’Ordine.
Il pagamento attraverso PayPal avverrà mediante reindirizzamento al sito PayPal, dove potranno essere perfezionate le procedure di trasferimento delle somme dovute a RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc.
I dati finanziari del Cliente verranno gestiti direttamente da PayPal e non saranno condivisi con RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc.
L’importo complessivo relativo a ciascun Contratto di Vendita verrà addebitato contestualmente alla conclusione del processo d’ordine.

Comunicazioni e Reclami
Tutte le comunicazioni o gli eventuali reclami nei confronti di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc dovranno essere indirizzati al Servizio di Assistenza Clienti di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc.

Diritti di proprietà intellettuale
Il Cliente dichiara e riconosce che tutti i marchi, disegni, modelli, segni distintivi, opere dell’ingegno, software e banche dati, ovvero ogni altro diritto di proprietà intellettuale ed industriale accessibile dal e/o riprodotto sul Sito in ogni modo e/o forma, ivi incluso il marchio CRECYMODELS.COM, sono di esclusiva titolarità di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc ovvero RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc né è legittima licenziataria (i “Diritti di Proprietà Intellettuale”).
RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc non risponde, tuttavia, dei diritti di proprietà intellettuale relativi ai Prodotti e/o Servizi in vendita i cui titolari sono ivi espressamente indicati. Qualsiasi utilizzazione dei Diritti di Proprietà Intellettuale in qualsiasi modo e/o forma, in tutto e/o in parte è vietata senza la preventiva autorizzazione scritta di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc o dei suoi licenziatari.

Normativa di riferimento – Foro competente
Le presenti Condizioni Generali sono rette dalla legge italiana così come ciascun Contratto di Vendita e soggette alla giurisdizione italiana. Ogni controversia relativa alle Condizioni Generali ovvero ai Contratti di Vendita sarà devoluta alla competenza esclusiva del Foro di Milano, fermo restando l’applicabilità delle norme inderogabili di legge poste a tutela dei Consumatori.

Condizioni di fornitura
Nel Sito vengono indicati i tempi complessivi di consegna perché il Prodotto ordinato dal Cliente entri nella piena disponibilità di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc, sia pronto per la spedizione e consegnato al Cliente.
Per la consegna del Prodotto ordinato al Cliente o al terzo destinatario indicato dal Cliente occorrerà, pertanto, considerare i tempi indicati. Nel caso di omessa indicazione di un termine specifico di consegna, essa avverrà entro trenta giorni a decorrere da quello successivo all’invio dell’ordine.
I tempi di disponibilità e di consegna possono subire variazioni rispetto a quanto riportato, sia a causa del contemporaneo accesso di utenti, sia in quanto dipendenti da fornitori terzi e non controllabili. RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc, pertanto, non si impegna, né garantisce il pieno rispetto dei tempi di consegna indicati sul Sito e/o nell’Ordine, né si riterrà responsabile per eventuali ritardi.
Nessuna responsabilità, a qualsiasi titolo, potrà essere addebitata dal Cliente a RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc, in caso di ritardo nell’evasione dell’Ordine o nella consegna del Prodotto oggetto dei Contratti di Vendita.
Tutte le spedizioni dei Prodotti saranno a rischio di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc. Il rischio si trasferirà al Cliente all’atto di consegna dei Prodotti.
Per effettuare correttamente la consegna dei Prodotti ordinati, è sempre richiesta la presenza del Cliente o di un suo incaricato. Ove nessuno di essi fosse reperibile al momento e nel luogo di consegna dei Prodotti acquistati, il corriere lascerà un avviso di seconda consegna per il giorno lavorativo successivo ed un recapito telefonico per potere concordare una diversa data.
L’esecuzione dell’Ordine resterà sospeso presso la filiale del corriere e se non sarà possibile effettuare la consegna, trascorsi 5 giorni il Prodotto rientrerà presso i magazzini di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc. Una volta rientrato da RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc, il Cliente verrà contattato dall’Assistenza Clienti e potrà decidere se effettuare una seconda spedizione o se richiedere il rimborso dell’intero Ordine (ovviamente escluso contrassegno). Se anche la seconda spedizione non dovesse andare a buon fine, si procederà al rimborso dell’Ordine.
Il relativo Contratto di Vendita si intenderà così automaticamente e definitivamente risolto, fatto salvo il diritto di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc al maggior danno. Nei casi di forza maggiore, indisponibilità dei mezzi di trasporto, eventi imprevedibili, RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc si riserva il diritto di risolvere il Contratto di Vendita ovvero di frazionare, rinviare o cancellare, in tutto o in parte, la consegna prevista, ove detti eventi provochino un ritardo nelle consegne ovvero le rendano difficili o impossibili e/o causino un significativo aumento del loro costo a carico di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc.
In tali ipotesi, sarà compito di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc fornire tempestiva comunicazione delle proprie determinazioni all’indirizzo di posta elettronica del Cliente. Quest’ultimo, in tali casi avrà diritto ad ottenere la restituzione del prezzo eventualmente corrisposto, esclusa qualsiasi ulteriore pretesa o risarcimento, a qualsiasi titolo, nei confronti di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc.

Condizioni di recesso

Diritto di Recesso Del Cliente – Recesso di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc
Ai sensi degli artt. 64 e seguenti del Codice del Consumo, il Consumatore ha diritto a recedere dall’acquisto senza alcuna penalità e senza specificarne il motivo. A tal fine dovrà inviare comunicazione al Servizio Assistenza Clienti di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc via posta elettronica o – in alternativa – mediante fax o lettera raccomandata con avviso di ricevimento, da spedirsi entro il termine di 14 giorni lavorativi dalla ricezione dei Prodotti e/o Servizi prescelti. La restituzione dei Prodotti oggetto di recesso dovrà essere effettuata, a cura e spese del Consumatore, a mezzo corriere di propria scelta, al seguente indirizzo: RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc, Via Madonna, 37 – Cambiago (MI) – 20040 Ai fini del valido esercizio del diritto di recesso, il Consumatore dovrà rispettare le seguenti condizioni e modalità: il recesso potrà applicarsi anche limitatamente ai singoli prodotti oggetto di un unico Contratto di Vendita, fermo restando che il Consumatore non potrà esercitare il recesso limitatamente ad una parte del singolo Prodotto acquistato; tutti i Prodotti per i quali il Consumatore abbia esercitato il diritto di recesso dovranno essere restituiti integri e opportunamente imballati, preferibilmente nella loro confezione originale, corredati di tutti gli eventuali accessori. Qualora il Prodotto per il quale è stato esercitato il diritto di recesso pervenga danneggiato ad RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc, questa sarà tenuta esclusivamente a darne comunicazione al Consumatore allo scopo di consentirgli, ove possibile, di esercitare il proprio diritto di rivalsa nei confronti del corriere prescelto per la restituzione dei prodotti; RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc non risponderà in nessun caso per danneggiamenti, furti o smarrimenti di Prodotti oggetto di reso, sino all’avvenuta riconsegna degli stessi. Ogni rischio sarà, pertanto, a carico esclusivo del Consumatore. Una volta verificata l’integrità del Prodotto restituito, RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc provvederà a rimborsare il Consumatore dell’intero importo pagato per i Prodotti e/o Servizi di cui al Contratto di Vendita oggetto di recesso, entro e non oltre 14 giorni dalla ricezione dei medesimi dalla comunicazione di recesso da parte del Cliente, fermo restando il diritto di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc di trattenere il rimborso fino alla ricezione dei prodotti resi. Il rimborso avverrà impiegando la stessa modalità di pagamento fornita dal Consumatore al momento della formulazione dell’Ordine. Qualora il Consumatore violi, in tutto o in parte, le disposizioni dettate in materia di recesso dalle presenti Condizioni Generali, il Contratto di Vendita resterà valido ed efficace ed RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc provvederà a restituire i Prodotti indebitamente resi al Consumatore, addebitando a quest’ultimo le relative spese di spedizione. RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc ha diritto di recedere da ciascun Contratto di Vendita concluso dal Cliente o dal Consumatore, dandone allo stesso comunicazione scritta tramite e-mail e raccomandata a/r, così come potrà non accettare alcun Ordine da parte di utenti o Clienti che abbiamo attuato comportamenti non regolari, non abbiamo accettato i Prodotti acquistati in contrassegno, siano sospettati di comportamenti contrari alla legge o sia imposto da un ordine di una autorità giudiziaria.

Garanzia – Resi
Qualora i Prodotti o Servizi godano di una garanzia convenzionale riconosciuta dal produttore, eventuali vizi, difetti o difformità dovranno essere denunciati direttamente al produttore come indicato sulla confezione del Prodotto o nella brochure illustrativa. Salvo previsioni inderogabili di legge, RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc dichiara di non avere alcuna responsabilità in merito a vizi, difetti o difformità di prodotto. Resta salva la garanzia per il Consumatore ai sensi del D.Lgs. 206/2005. Il Consumatore in tal caso dovrà, a pena di decadenza, denunciare a RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc il difetto riscontrato al Servizio Assistenza Clienti di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc entro il termine di 2 (due) mesi dalla data della scoperta. RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc compirà ogni ragionevole sforzo per sostituire, a proprie spese ed entro un temine congruo, il prodotto difettoso. Ove ciò non fosse possibile, o risultasse eccessivamente oneroso per RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc, il Consumatore avrà diritto a risolvere il Contratto di Vendita e, conseguentemente, ad ottenere il riaccredito delle somme versate per l’acquisto e la spedizione del Prodotto, restando esclusa ogni ulteriore responsabilità di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc, a qualunque titolo e per qualsivoglia ragione. Ove il Cliente rilevasse eventuali difformità tra quanto ordinato e quanto ricevuto, ed in particolare, riscontrasse qualsiasi problema inerente l’integrità fisica, la corrispondenza o completezza dei prodotti ricevuti, dovrà tempestivamente informare il servizio Assistenza Clienti di RONCHI & RONCHI di Ronchi D. e Ronchi M. Snc. L’assistenza Clienti provvederà a fornire le indicazioni necessarie alla soluzione del problema, e ove possibile, alla spedizione degli articoli mancanti, alla sostituzione degli articoli difettosi oppure al loro rimborso. In nessun caso sarà richiesta al Cliente la restituzione a proprie spese di articoli difettosi o ricevuti per errore.
